XeroBank Terms of Service

Version 1.4

This document applies to XeroBank goods and services but not XeroBank open-source software. Use of XeroBank goods and services signifies understanding, agreement, and complete acceptance of these terms. All disputes or controversies of any nature between clients and XeroBank at any time may be determined by binding arbitration by a 3rd party to be named by XeroBank.

Users are prohibited from engaging in actions that threaten XeroBanks's ability to offer commercial goods and services.

Prohibited Activity: XeroBank will not tolerate the use of our services for scams, fraud, theft, hacking, denial of service, spam, underage erotic materials, violence, or threats of violence. While XeroBank allows traffic to exit from non-originating countries, we insist that you abide by the laws of the jurisdiction from which you access XeroBank services. All incoming connections are known to XeroBank, and outgoing traffic can be traced by XeroBank. We employ the use of intelligent monitoring software to assist and notify XeroBank of such activities. In the case that our monitoring software flags traffic as suspicious or malicious, XeroBank may begin to log the traffic and/or dispatch a human auditor to determine the nature of the activity. If the activity is found to be non-malicious, the flags are removed, and the logs are wiped. Violation of these terms may result in immediate suspension, investigation, or notification of authorities.

File Sharing: File sharing is permitted and encouraged as a legitimate method of transferring files. However, XeroBank services are not intended to be used for sharing of illegal or copyrighted works. In order to avoid anonymous seeding of infringing material, XeroBank does not allow Universal Plug and Play protocol. This does not affect downloading ability, only uploading ability.

Conditions of Sale: Due to the nature of the service XeroBank provides, XeroBank does not issue refunds for unused portions of XeroBank service. All sales are final, however, XeroBank will assist rebilling cancellations. If there are extenuating circumstances, such as an account that has never been used, and XeroBank decides to perform a refund, XeroBank reserves the right to prorate any refund for cost of time, support, fixed costs for setting up accounts, and services rendered.

Exercise of rights enumerated in the Universal Declaration of Human Rights will not be considered violations of the XeroBank Terms of Service.
